Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Fishing Spot mobile application (the "App") provided by Fishing Spot ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.

2. Your account

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the App, except where such restrictions are prohibited by law.

4. Acceptable use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Post content that is illegal, infringing, harmful, harassing, misleading, or otherwise objectionable;
• Upload false catch data or attempt to manipulate maps, feeds, or rankings;
• Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems;
• Use automated means to access or scrape the App; or
• Infringe the intellectual property or privacy rights of others.

5. User content

The App lets you create content, including catches, photos, notes, and community posts ("User Content"). You retain ownership of your User Content. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content for the purpose of operating and improving the App and, where you choose to share, displaying it to other users.

You are responsible for your User Content and represent that you have the rights to post it. We may remove content that violates these Terms or that we consider objectionable, at our discretion.

6. AI identification & forecasts

The App provides AI-based fish identification, weather, bite-time, and other forecast information for convenience only. These results are estimates and may be inaccurate or incomplete. Do not rely on them as authoritative identification, scientific, safety, or navigational advice. Always verify species and conditions independently, especially where regulations, edibility, or safety are involved.

7. Safety & local laws

Fishing involves inherent risks. You are solely responsible for your own safety and for complying with all applicable fishing licenses, regulations, seasons, catch limits, protected-species rules, and property/access laws in your area. The App does not grant any right to access private property or protected areas.

8. Premium subscriptions

Fishing Spot offers an optional paid subscription ("Premium") that unlocks additional features. Subscriptions are billed through your app store account.

• Payment is charged to your app store account at confirmation of purchase.
• Subscriptions renew automatically for the same period and price unless canceled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription in your app store account settings. Deleting the App does not cancel a subscription.
• Any free-trial portion is forfeited when you purchase a subscription, where applicable.
• Except where required by law or app store policy, payments are non-refundable.

9. Intellectual property

The App and its content — excluding User Content — including software, design, text, graphics, and logos, are owned by us or our licensors and are protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

10. Third-party services

The App integrates third-party services (such as authentication, hosting, analytics, mapping, weather, and payment providers). We are not responsible for the availability, accuracy, or practices of third-party services, which are governed by their own terms and policies.

11. Termination

You may stop using the App at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms or if we discontinue the App. Upon termination, the licenses granted to you end, though provisions that by their nature should survive will remain in effect.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
